Another modifier 25 question

We are dermatology and perform a minor surgery with a majority of our patient visits. I know the rules state that a separate diagnosis does not need to be listed to charge out an E/M the same day as a surgery but I can't come up with a scenario where you could charge the E/M with the same diagnosis as the minor surgery. Does anyone have an instance where an E/M could be charged out with a minor procedure and have the same diagnosis. The modifier 25 rules lead me to the conclusion that even though it states you don't need a separate diagnosis in almost all instances the E/M won't be paid unless you have a different diagnosis than the minor procedure. Any thoughts?
