Incident To Sleep Center

If the patient is being seen by a NP for something like a follow up of sleep apnea and the NP adjusts the CPAP settings, could this encounter be billed incident to? The provider specifically documented adjust CPAP setting as needed in the initial note where the plan of care was established.

  • Yes this is for Medicare only and it would be established E&M codes 99212-99215. We were thinking if the physician had a standard protocol for the NP to follow that then it could be considered incident to as long as in the physicians original note it is stated to follow the standard protocol for adjusting the CPAP as needed.
